Michael Kandola, 20, appeared in Vancouver’s community court on Monday morning. (CBC)A man accused of attacking a gay man over the weekend in the city’s West End appeared briefly in Vancouver’s new community court on Monday morning.
But the prosecutors said that Michael Kandola, 20, of Vancouver was being charged with an indictable offence, and the punishment they would be seeking went beyond the scope of community court
Insp. John McKay said Sunday police were recommending charges of assault causing bodily harm and a hate crime charge, but it was not yet clear if Kandola has been charged by the Crown.
Police are looking for at least three other suspects in the case.
A special prosecutor will be appointed to handle the case, said the Crown prosecutors. The case was rescheduled for the normal provincial court on Tuesday morning
Kandola has not been held in custody since his arrest, and left the court on his own, pushing through a crowd of reporters outside to step into a waiting car.
Davie Street assault lead to arrest
Kandola, was released from jail Saturday evening after being arrested in West End alley, following an alleged assault on a gay man on Davie Street early Saturday morning .
Kandola was questioned by reporters after leaving the court house Monday morning. (CBC)Jordan Smith, 27, was walking along Davie Street, near Hornby Street, holding hands with another man when a group of four young men approached the pair, calling out gay slurs, Smith told CBC News.
One of the men allegedly hit Smith in the face with enough force that he fell back on the sidewalk and was knocked unconscious.
Smith’s jaw was dislodged and fractured in a number of places, and he’s scheduled to go in for surgery Monday, which will leave his jaw wired shut for six weeks.
Smith says these attacks on gays, even in Vancouver’s West End, are happening more often than people think.
“I think there are a number of people who wander up that way, maybe on a weekend, looking for trouble, looking to cause a fight,” said Smith.

Davie street is known to have a large gay community and I would of loved to hear a bunch of gay men beat the crap out of these guys. Not to promote violence but i think thatd be pretty funny.

Wow… I read the article in this ezine, linked to above, and the level of ignorance is mind boggling. To suggest that there is no hate crime because this was a closeted gay beating up another gay is just, just, amazingly ignorant on the writers part.

I live in Vancouver and I’m extremely appalled at this incident, but unfortunately even in a mostly gay-friendly Vancouver, our brothers and sisters are being exposed to homophobia all the time, perhaps to a lesser degree (name calling, taunting) but it’s all unacceptable. Some good may have come out of this, however – I feel that through this incident the media will perhaps start to pay more attention to the subject of homophobia in our city, and with the federal election coming up, people should be reminded that human rights issues are more important than ever.

Twenty years would be excessive, I agree, however, 2-3 years, plus restitution for all medical costs and loss of employment income would suffice.
What baffles my mind is that this guy, of all people, a visible minority, whose parents, in all likelihood, suffered the same type of abuse, should have know better. There is simply no excuse for an unprovoked attack on anyone walking down the street.

I went to school with Michael, preschool all the way to highschool. I saw him on the new today, and i no longer live in Vancouver, and i was very surprise. I can’t believe he would do such thing..
